Terms of Service

1. Purpose

These terms govern the use of AltiusForms, form-building software published by Altius Group SNC ("we"), and of the altiusforms.com website and customer area. By creating an account or subscribing, you accept them.

2. The service

AltiusForms is provided as a dedicated instance: each customer gets its own application, with its own database, its own storage and its own address (for example your-name.altiusforms.com). There are two options:

• Hosted: the instance runs on our servers. We install it, update it and back it up every night.
• Self-hosted: you install the instance on your own infrastructure with a licence key, together with a separately agreed maintenance contract.

3. Account

You need an account to subscribe. You provide accurate information and keep it up to date. You keep your credentials confidential and are responsible for any use of your account.

4. Free trial

Each plan (Starter, Business, Enterprise) may include a free trial, 14 days unless the pricing page states otherwise. Nothing is charged during the trial. If you do not cancel before it ends, the subscription continues and the first period is billed.

5. Prices and payment

Prices are in Swiss francs (CHF), excluding VAT; applicable VAT is added to the invoice. Subscriptions are monthly or yearly and renew automatically. Payment is by card through Stripe. For payment by invoice or a self-hosted licence, we prepare a quote on request.

6. Changing plan

You can change plan at any time from your customer area. The instance is resized accordingly and the price difference is prorated.

7. Termination

You can cancel from your customer area. Cancellation takes effect at the end of the paid period; the instance remains available until then. It is your responsibility to export your forms and answers before that date. We may suspend or terminate a subscription for non-payment or serious breach of these terms.

8. Your obligations

You are responsible for the content of your forms and for the answers you collect. In particular, you must have a legal basis for collecting them and inform the people who fill in your forms. You manage the users, roles and access rights of your instance.

9. Acceptable use

You may not use AltiusForms to collect data unlawfully, for phishing, spam, distributing unlawful content or malware, or to attempt to bypass the security of the service.

10. Availability and maintenance

We aim for high availability of hosted instances but do not guarantee uninterrupted service. Updates and maintenance are scheduled outside peak hours wherever possible.

11. Backups

Hosted instances are backed up every night. Backups are for recovery after an incident; they do not replace your own exports. For a self-hosted instance, backups are your responsibility.

12. Data protection

How we process personal data is described in our privacy policy. For the answers collected in your instance, you are the controller; when we host the instance, we act as your processor.

13. Intellectual property

AltiusForms and its components are the property of Altius Group SNC. Your subscription or licence grants a non-exclusive, non-transferable right of use for the term of the contract. A self-hosted licence key is tied to one instance and cannot be transferred. Your forms and answers remain yours.

14. Liability

To the extent permitted by Swiss law, we exclude liability for slight negligence and for indirect damage, including loss of profit or data. Liability for intent and gross negligence is unaffected.

15. Changes

We may amend these terms. Significant changes are announced by email or in the customer area before they take effect.

16. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is the registered office of Altius Group SNC, subject to mandatory places of jurisdiction.
